Preamble

absoluteZero multimedia GmbH (hereinafter "Seller") offers various products through its online shop. The following terms govern the contractual relationship between the Seller and the customer and supplement the statutory provisions.

1. Offer and conclusion of contract

1.1 The Seller's offers are subject to technical changes. Details of weight and dimensions are approximate values customary in the trade. The Seller assumes no procurement risk.

1.2 The customer's order constitutes a binding offer, by which the customer is bound for 7 calendar days. The contract is concluded by the Seller's order confirmation or by delivery of the goods within 7 days.

2. Prices and payment

2.1 The prices stated at the time of the order apply. All prices include statutory VAT (7 % or 19 %) plus shipping costs (postage and packaging).

2.2 Payment, both domestic and international, is made in advance or through the payment service provider PayPal. For payment in advance, the bank details are provided with the order. The invoice amount is due within 8 days.

3. Delivery and shipping

Goods are dispatched after receipt of payment, Monday to Friday. The customer receives a confirmation by email once the goods have been shipped. Shipping costs depend on the destination country and package size; details can be found under Delivery & shipping.

4. Right of withdrawal

4.1 Consumers have a statutory right of withdrawal. The withdrawal period is fourteen days. Details and the address for the notice of withdrawal can be found in our right of withdrawal.

4.2 The customer bears the direct cost of returning the goods. The Seller does not provide return labels. Indicative return costs can be found under Delivery & shipping; the actual amount depends on the carrier and shipping method chosen by the customer.

4.3 In the event of an effective withdrawal, the Seller refunds the purchase price and the cost of delivery for the least expensive standard delivery offered; additional costs of a different type of delivery chosen by the customer are not refunded. The Seller may withhold the refund until it has received the goods back or the customer has supplied evidence of having sent them back, whichever is the earliest.

5. Warranty

The statutory provisions on liability for defects apply. Damage resulting from improper use or natural wear and tear is excluded from the warranty.

6. Liability

The Seller is liable without limitation for intent and gross negligence and in accordance with the German Product Liability Act. For simple negligence the Seller is liable only for breach of an essential contractual obligation (cardinal obligation), and limited to the foreseeable damage typical of the contract. Liability for injury to life, body or health remains unaffected.

7. Retention of title

The goods delivered remain the property of the Seller until paid for in full.

8. Applicable law and place of jurisdiction

The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For merchants, the exclusive place of jurisdiction is the Seller's registered office. Towards consumers this agreement on jurisdiction applies only insofar as permitted by law.

9. Severability

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions remains unaffected.

10. Packaging Act

The Seller complies with its obligations under the German Packaging Act (VerpackG). Sales packaging is disposed of or licensed within the statutory requirements.

11. Amendments

Amendments or additions to these terms must be made in text form.
